Providing Effective Tax Resolution Services for Difficult Tax Problems

When you owe back taxes or have another difficult tax problem, take the first step toward resolving it by working with an experienced tax attorney. At Timothy S. Hart Law Group, our respected tax attorney has a successful record of providing effective solutions in both IRS and New York tax department matters. He can help you when you are faced with:

  • Whether its many years of unfiled tax returns or a large tax balance (over $15,000). As a tax attorney who is also an experienced NYS certified public accountant he has the right Tax Resolution experience to help you, Tim can prepare unfiled tax returns, while also resolving or minimizing criminal exposure. Typically, our law firm can handle the entire case without your needing to talk to either the IRS or the NYS tax department.
  • A levy of your bank accounts, cars and other assets by the IRS or NYS tax authorities. Correcting a levy requires knowledge that most taxpayers subject to this enforcement action do not possess.
  • An income or sales tax audit, when you know that the numbers on your return are incorrect or you feel uncomfortable dealing with the audit in general. Naturally, in both situations it would be best to have a “spokesman” tax expert handle this situation so you do not have to talk directly to tax authorities.
  • A IRS tax lien or NYS tax warrants. Tax liens and warrants can make it very difficult to sell your assets or take out loans, and they are often the precursor to tax levies.

Our Four-Step Tax Resolution Service Plan

Tim Hart has a four-step plan for resolving tax problems. He will work personally with you through each step in the process. Read on to learn about each step in detail.

1. We will discuss and analyze your tax problem.

To help resolve your problem, we need to understand your tax history and financial situation. Once we have learned all the facts about your tax and financial circumstances, we will be prepared to represent you.

At our initial meeting, we will advise you about possible solutions for your case and the fees for our services. We do not charge for this initial consultation. If you decide to engage our firm, we will prepare a written agreement describing the terms of the engagement, including what we will do for you, and the cost.

Once you sign the retainer agreement, we will prepare a power of attorney form (IRS Form 2848) and (New York State POA-1) that enables us to speak to the IRS or New York State tax department on your behalf. This power of attorney is limited to only representing you before the IRS or state tax authorities and is revocable at any time.

2. We will collect all the information that the IRS or state has related to your tax accounts and carefully review it.

We want to make sure we know all the information tax authorities have related to your account so there are no surprises or misunderstandings about your tax issue. Often, the tax data we obtain from the IRS or NYS tax department will assist us in determining the best strategy to take to resolve your tax problem.

3. We will collect financial documents from you and analyze them.

By obtaining accurate financial documents from you, it allows us to see what we can do to improve your situation and reduce your tax liabilities. We also need this information to prepare your tax returns. The types of financial information that we will request from you include wage statements, bank statements, mortgage statements, brokerage statements, Form 1099, etc…

When providing this information, it is important to remember that tax authorities have the right to question any number on your tax return. We will provide informed guidance to you on what is allowable under the law and what is not.

4. We will develop an exclusive strategy to solve your tax problem.

After we thoroughly review and discuss your current financial situation with you, we will assist you in deciding on a solution that best suits you. There are a variety of solutions, including an offer in compromise, tax installment agreement, or a variation of the two methods. We will discuss each solution with you and advise you so you can make an informed decision.

Our skill at negotiating with the IRS and the NYS tax department will allow you to pay off your debt in a reasonable and timely manner.
